Acceptance of Terms

By accessing and using Moni’s services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Important Disclosures

Moni is not a bank. Moni is a financial technology company, not a bank or licensed money transmitter. Banking services and money transmission are provided by our licensed partners. Your funds are not insured by the Federal Deposit Insurance Corporation (FDIC) or any other governmental agency unless explicitly stated otherwise for specific services provided through our banking partners.

Service Description

Moni provides digital payment and money transfer services, including:

  • Cross-border money transfers
  • Digital wallet functionality
  • QR code payment processing
  • Financial technology solutions

Eligibility

To use our services, you must:

  • Be at least 18 years old
  • Have legal capacity to enter into agreements
  • Comply with all applicable laws and regulations
  • Provide accurate and complete information

Identity Verification (KYC) and Anti-Money Laundering (AML)

Compliance Requirements

Moni is committed to preventing money laundering, terrorist financing, and other financial crimes. To comply with applicable laws and regulations, we are required to verify your identity and may monitor your transactions.

Your Obligations

By using our services, you agree to:

  • Provide accurate, complete, and up-to-date identification documents when requested
  • Complete any identity verification procedures required to access or continue using our services
  • Promptly respond to requests for additional information or documentation
  • Not use our services on behalf of any third party without proper authorization and disclosure
  • Not use our services for any illegal purposes, including money laundering or terrorist financing

Our Rights

We reserve the right to:

  • Request additional documentation or information at any time to verify your identity or the source of funds
  • Limit, suspend, or terminate your account if you fail to provide requested information or if we suspect fraudulent or illegal activity
  • Delay, block, or refuse any transaction that we believe may violate applicable laws or our policies
  • Report suspicious activity to relevant authorities as required by law, without prior notice to you
  • Conduct ongoing monitoring of transactions and account activity

Sanctions Compliance

We screen users and transactions against applicable sanctions lists, including those maintained by the U.S. Office of Foreign Assets Control (OFAC). You represent that you are not located in, a resident of, or a national of any sanctioned country, and that you are not on any sanctions list.

Account Registration

Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized use

Account Security

  • Keep your login credentials confidential
  • Enable two-factor authentication when available
  • Report suspicious activity immediately

Third-Party Services & Blockchains

Moni may integrate with third-party services and blockchain networks to provide certain features. You acknowledge that these third-party services operate independently and are subject to their own terms and conditions.

Partner Services. Certain features of the Service, including fiat on‑ramps and off‑ramps available to users in the United States, are provided through our regulated partners.

By accepting these Terms, you acknowledge that your information may be shared with and processed by these partners. For payment processing services provided by Astra Finance, please review their privacy policy at https://astrafi.com/privacy/.

Digital Assets and Blockchain Risks

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY BEFORE USING OUR SERVICES.

Transaction Finality

All blockchain transactions are final and irreversible. Once a transaction is broadcast to the blockchain network, it cannot be canceled, reversed, or refunded. This includes:

  • Transfers to other wallets
  • Cross-border payments
  • Payments for goods or services
  • Any other on-chain transaction

You are solely responsible for verifying the accuracy of recipient addresses and transaction amounts before confirming any transaction. Moni cannot recover funds sent to incorrect addresses or reverse completed transactions.

Digital Asset Risks

By using our services, you acknowledge and accept the following risks:

  • Volatility: Digital asset prices can fluctuate significantly in short periods. You may lose some or all of the value of your digital assets.
  • Regulatory Uncertainty: The regulatory status of digital assets varies by jurisdiction and may change. Regulatory actions could adversely affect the value or usability of digital assets.
  • Technology Risks: Blockchain networks may experience congestion, forks, or technical failures that could delay or affect your transactions.
  • Security Risks: Despite security measures, digital assets may be subject to hacking, theft, or other malicious attacks. You are responsible for securing your account credentials and devices.
  • Network Fees: Blockchain transactions require network fees (gas fees) that are paid to network validators, not to Moni. These fees vary based on network congestion and are non-refundable.

No Investment Advice

Moni does not provide investment, financial, tax, or legal advice. The information provided through our services is for informational purposes only. You should consult with qualified professionals before making any financial decisions. Past performance of any digital asset is not indicative of future results.

No Guarantee of Value

Moni makes no guarantees regarding the value, stability, or liquidity of any digital assets accessible through our services. Digital assets are not legal tender and are not backed by any government.

Acceptable Use

Permitted Activities

  • Legitimate financial transactions
  • Personal and business payments
  • Compliance with applicable laws

Prohibited Activities

  • Money laundering or terrorist financing
  • Fraudulent transactions
  • Violation of sanctions or embargoes
  • Illegal activities or transactions

Fees and Charges

Transaction Fees

  • Fees are clearly displayed before each transaction
  • Fees may vary based on transfer amount and destination
  • All fees are non-refundable once a transaction is initiated

Additional Charges

  • Currency conversion fees may apply
  • Third-party fees may be charged by banks or payment processors
  • We will disclose all applicable fees upfront

Transaction Limits

Daily Limits

  • Maximum daily transfer amount: $500
  • Limits may vary based on account verification level

Monthly Limits

  • Maximum monthly transfer amount: $5,000
  • Limits may vary based on account verification level

Error Resolution (Fiat Transactions Only)

The following error resolution procedures apply only to fiat currency transactions (such as bank transfers and card payments processed through our partners). Blockchain transactions are final and irreversible and are not subject to these procedures.

Reporting Errors

If you believe an error has occurred with a fiat transaction, contact us immediately at support@moni.lat. Errors include:

  • Unauthorized fiat transactions from your account
  • Incorrect transaction amounts
  • Transactions not properly credited or debited
  • Computational or bookkeeping errors

To report an error, provide:

  • Your name and the email address or phone number associated with your account
  • Description of the error and why you believe it is an error
  • The dollar amount involved
  • The approximate date of the error

Investigation Timeline

  • We will investigate your complaint and determine whether an error occurred within 10 business days of receiving your report
  • If we need more time, we may take up to 45 days to complete our investigation
  • We will notify you of the results of our investigation within 3 business days of completing it

Unauthorized Fiat Transactions

To minimize your liability for unauthorized fiat transactions:

  • Notify us immediately if your device is lost or stolen, or if you believe your account credentials have been compromised
  • Review your transaction history regularly
  • Never share your login credentials, PIN, or authentication codes with anyone

Your liability for unauthorized fiat transactions may be limited under applicable law if you notify us promptly. Contact us immediately if you suspect unauthorized activity.

Dispute Resolution

Transaction Disputes

  • Report disputes within 30 days of the transaction appearing in your account
  • We will investigate and respond within the timelines specified above
  • Provide all relevant documentation and evidence

Resolution Process

  • Informal resolution through customer support
  • Formal dispute resolution if informal methods fail
  • Arbitration for unresolved disputes as described in the Governing Law section

Disclaimers and Warranties

Service Provided “As Is”

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Moni disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the services will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any information provided through the services
  • Warranties regarding the results that may be obtained from the use of the services

Third-Party Services

We do not warrant or guarantee the performance, availability, or reliability of any third-party services, including blockchain networks, banking partners, or payment processors. Your use of third-party services is at your own risk and subject to their respective terms.

No Guarantee of Access

We do not guarantee continuous, uninterrupted access to our services. The services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Liability and Indemnification

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Moni shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
  • Moni’s total liability for any claims arising from or related to these Terms or the services shall not exceed the greater of (a) the fees you paid to Moni in the 12 months preceding the claim, or (b) $100
  • Moni is not liable for losses resulting from blockchain network failures, third-party service disruptions, or circumstances beyond our reasonable control

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if Moni has been advised of the possibility of such damages.

Your Indemnification

You agree to indemnify, defend, and hold harmless Moni and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your violation of any third-party rights

Termination

Account Termination

  • We may terminate accounts for violations of these terms
  • You may close your account at any time
  • Outstanding obligations must be fulfilled before termination

Service Suspension

  • We may suspend services for security or compliance reasons
  • Suspension will be lifted once issues are resolved
  • We will provide notice of suspension when possible

Changes to Terms

Modification Process

  • We may modify these terms at any time
  • Changes will be effective 30 days after posting
  • Continued use constitutes acceptance of changes

  • We will notify you of material changes
  • Check our website regularly for updates

Governing Law and Dispute Resolution

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Moni agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration Rules and Procedures:

  • Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules
  • The arbitration will be conducted in English and held in Delaware, unless you and Moni agree otherwise
  • The arbitrator shall have exclusive authority to resolve all disputes, including the arbitrability of any claim
  • The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction

Arbitration Costs:

  • If you initiate arbitration, you will be responsible for paying the AAA filing fee
  • Moni will pay all remaining AAA fees and arbitrator compensation
  • Each party shall bear its own attorneys’ fees unless the arbitrator determines that a claim was frivolous

Opt-Out Right:

You may opt out of this arbitration agreement by sending written notice to legal@moni.lat within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, you may pursue claims in court but the class action waiver below still applies.

Class Action Waiver

You and Moni agree that any disputes will be resolved on an individual basis only, and not as part of any class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Moni. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section shall be null and void.

By using our services, you consent to receive all communications, agreements, documents, notices, and disclosures electronically, including via email, push notifications, or through our website or mobile application. This consent applies to:

  • These Terms of Service and any updates
  • Privacy Policy and other legal notices
  • Transaction receipts and confirmations
  • Account statements and history
  • Customer service communications
  • Marketing communications (where you have opted in)

E-SIGN Act Disclosure

In accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), you agree that your electronic acceptance of these Terms constitutes your signature and consent to be bound by these Terms. You acknowledge that:

  • Electronic records and signatures have the same legal effect as paper documents and handwritten signatures
  • You have the ability to access, download, and print electronic communications
  • You have an active email address and access to the internet

Hardware and Software Requirements

To access and retain electronic communications, you need:

  • A device with internet access (computer, smartphone, or tablet)
  • A current web browser that supports TLS 1.2 or higher
  • An active email account
  • Sufficient storage space or a printer to save or print communications

You may withdraw your consent to receive electronic communications by contacting us at legal@moni.lat. However, withdrawing consent may result in the termination of your account, as electronic communication is required to use our services.

Intellectual Property

Moni’s Intellectual Property

The Moni name, logo, and all related trademarks, service marks, and trade names are the property of Paymentstack Inc. The services, including all software, text, graphics, user interfaces, and other content, are owned by or licensed to Moni and are protected by copyright, trademark, and other intellectual property laws.

Limited License

Subject to your compliance with these Terms, Moni grants you a limited, non-exclusive, non-transferable, revocable license to access and use the services for your personal, non-commercial purposes. This license does not include the right to:

  • Modify, copy, or create derivative works based on the services
  • Reverse engineer, decompile, or disassemble any part of the services
  • Remove any copyright, trademark, or other proprietary notices
  • Use the services for any commercial purpose without our prior written consent
  • Use any automated means to access the services or collect information

Feedback

If you provide us with feedback, suggestions, or ideas regarding the services, you grant Moni a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
